Alpha Womb

Marshae Jones was charged with manslaughter over the death of the fetus she was carrying when shot in the belly. She was accused of beating up a co-worker who drew the gun and fired it at Ms. Jones. This resulted in the death of her 5 month old fetus. A grand jury dismissed the charges against the co-worker, saying she acted in self defense. However, the jury indicted Marshae Jones for “initiating a fight knowing she was five months pregnant.”

Under Alabama law, a fetus is considered to have the same rights as a child who has already been born. The grand jury wanted to hold someone responsible for the fetus’s death which resulted in Ms. Jones arrest. This gathered national attention and even outrage.


The charges against Marshae Jones were dropped thankfully. But this decision only came after the office of the woman who signed the indictment was flooded with angry calls and messages about the justice system. This system allowed for the woman who was shot to be arrested while the one shooting was able to walk free. Doesn’t seem like the best system if you ask us!

Most importantly, this arrest came weeks after Alabama lawmakers passed a law that effectively banned abortion at any stage of pregnant, even in cases of rape and incest. The laws are really looking out for the women being attacked in this country, right? Alabama has some of the strictest abortion laws in the country so this isn’t very shocking, but it is still just as upsetting. 


Reproductive rights activists viewed this arrest as an illustration of the legal ramifications of treating a fetus as a person in a court of law. People claim this is a cautionary tale of hoe pregnant women could be arrested and prosecuted in cases where they are seen to have endangered the fetus.
